This presentation will discuss changes in clients’ expectations, challenges in determining what is good professional practice, and opportunities and drawbacks in the current professional reliance environment. Bill Grainger P.Geo. will explore how forestry geotechnical practitioners can manage exposure to liability while meeting obligations to protect the public and environment.

PRACTICING HYDROLOGY UNDER FRPA

On November 21, 2002 the Forest and Range Practices Act was enacted that shifted much of the responsibility for forest management in BC to the forest industry and specifically the professional foresters. The government would no longer specify “how” to practice forestry in BC but rather focus on “objectives and results”. The responsibility for such things as the protection of the water resource was now up to the forest planners. The intent of this presentation is to provide a brief summary of how things have changed for hydrologists who are responsible for providing the necessary support to the forest planners and the professional foresters so that they are in compliance with the Act and its Regulations. The presentation will address both the positive and negative aspects of practicing hydrology under FRPA.

FOREST ENGINEERING LEGACY OF FPC AND THE NEW WORLD OF FRPA

The Forest Practices Code has recently been replaced by the Forest Range and Practices Act (FRPA). The timber harvesting business is now grappling with the products of the new legislation, most specifically with Forest Stewardship Plans (FSP's) and Site Plans (SP's). As industry moves away from the FPC, a variety of misconceptions regarding road and block engineering, construction, maintenance and deactivation developed. This was further compounded on the coast and to some degree in the Interior where licensee and license consolidation and Bill 28 resulted in new tenants on the landbase. This presentation will focus on the effects the change has had on BC Timber Sales (BCTS) operations in the Strait of Georgia Business Area, and how the multitude of issues are being addressed.

ASPECTS OF PROFESSIONAL RELIANCE RELATED TO FRPA

Professional reliance is one of the cornerstones of the Forest and Range Practices Act. The discussion paper by Roberta Reader (The Expectations That Affect the Management of Public Forests and Range Lands in British Columbia: Looking Outside the Legislation) reviews the roles that the resource professions have in non-demand side legislation, in relation to statutory requirements, common law and societal expectations. This session will provide an account of the professional practice guidelines, important documents that outline the expectations that professional bodies place on their Members, both currently in existance or in preparation by the Joint Practices Board.

RETAINING ENGINEERING AND GEOSCIENCE PROFESSIONALS UNDER FRPA

Under the relatively new legislative framework of the Forest and Range Practices Act and its associated regulations, there appears to be an increased focus to shift towards professional reliance and due diligence when compared to the somewhat prescriptive nature of the Forest Practices Code Act. This presentation will look at the various implications of the additional risks under FRPA to both the forest industry licensees and the provincial government. It will also explore issues related to the need to hire engineering and geoscience professionals.
