Stipulated Order – Nyima Tsundu, P.Eng., Burnaby, BC
A complaint was made to the Association regarding a structural engineering field review Mr. Tsundu provided for a large single-family dwelling in Lion’s Bay, BC The dwelling was not designed by Mr. Tsundu. The complaint was investigated by the designated reviewer and the Investigation Committee, which recommended an inquiry be held.
A Notice of Inquiry was issued alleging that Mr. Tsundu demonstrated unprofessional conduct in: conducting an inspection without the structural drawings; failing to inspect significant structural details; and failing to detect or report on numerous significant structural deficiencies.
In lieu of proceeding to a disciplinary inquiry, Mr. Tsundu accepted a Stipulated Order. Mr. Tsundu admitting that he was in breach of the Engineers and Geoscientists Act, and accepted as his penalty:
- a reprimand;
- payment to the Association $3,250.00 towards the cost of the investigation;
- that write and pass the Professional Practice Exam (PPE) within 6 months; and
- if he fails to pass the PPE within 6 months, his membership in the Association will be suspended until he has passed the PPE.
