Cancellation of Membership – Ken Dextras, New Westminster, BC

In the matter of the Engineers and Geoscientist Act, R.S.B.C. 1996, c. 116 (as amended) and Ken Dextras, P.Eng., a disciplinary inquiry was held to consider allegations that Mr. Dextras failed to respond to a request by the Investigation Committee for documents and information, contrary to section 30(4) of the Engineers & Geoscientists Act.

The discipline panel found Mr. Dextras liable of the charge of unprofessional conduct and made the following order regarding penalty and costs:

  1. Mr. Dextras is suspended from membership in the Association for 60 days, commencing 30 days from the date of the written Determination and Order (June 20, 2008);
  2. Mr. Dextras is to surrender to the Association his seal and Certificate of Registration for the duration of the suspension;
  3. Mr. Dextras is to pay the Association a fine of $5,000.00; and
  4. Mr. Dextras is to pay special costs in the amount of $16,500.00.
The Panel further ordered that Mr Dextras’ membership in the Association remain suspended until he has:
  1. Provided a response to the request from the Investigation Committee contained in the letter from Mr. Thiele of July 19, 2007, that is satisfactory to the Investigation Committee;
  2. Paid the fine to the Association in the amount of $5000.00; and
  3. Paid the special costs.

Mr. Dextras failed to comply with the discipline panel’s order and the matter was referred back to the panel.  In accordance with subsections 34(1) and 35(5) of the Act, the panel reconsidered this matter on November 13, 2009, and ordered that:

  1. the membership of Ken Dextras is cancelled effective the date of the Order; and

  2. the panel recommends that Council not consider any application for reinstatement for a minimum of two years and then only after Mr. Dextras has met all the conditions described in the original order.
