Dismissal of Appeal of Supreme Court Decision– Surinder S. Puar, P.Eng, West Vancouver, BC

The Association received information regarding geotechnical engineering services provided by Mr. Puar for a house in West Vancouver. The matter was referred to the Association’s Investigation Committee and an investigation was commenced. After reviewing the matter, the Investigation Committee recommended an inquiry be held and referred the matter to the Discipline Committee, which issued a Notice of Inquiry.

As previously reported in the January/February 2009 edition of Innovation, Mr. Puar challenged the jurisdiction of the Discipline Committee to hold an inquiry on various grounds.  Mr. Puar’s application to prohibit the disciplinary inquiry was denied by a Discipline Committee Panel and this decision was upheld on appeal to the BC Supreme Court. A further appeal by Mr. Puar to the BC Court of Appeal was also unsuccessful and an inquiry has been scheduled to commence on April 19, 2010.
