Stipulated Order - Avnash S. Banwait, P.Eng., Surrey, B.C.
A complaint was made to the Association regarding a concept review performed by Mr. Banwait. The matter was referred to the Investigation Committee, which decided it was appropriate to investigate the matter and eventually recommended that an inquiry be held.
A Notice of Inquiry was issued by the Association alleging the Mr Banwait demonstrated unprofessional conduct in delivering under seal a Record of Professional Structural Concept Review when the plans and documents reviewed had not been properly identified and contained numerous deficiencies in gravity and lateral loading.
In lieu of proceeding to an inquiry, Mr Banwait accepted an Order that he was in breach of the Engineers and Geoscientists Act, and accepted as his penalty:
- A reprimand;
- Payment of the legal and expert costs for the investigation of this matter in the amount of $7,728.
- That he write and pass the Professional Practice Exam;
- That he undergo a Practice Review at his own expense; and
- That until he has satisfied conditions 3 and 4 above, Mr. Banwait may not provide concept reviews.
