Self-Reporting of Unlawful or Unethical Conduct
The Code of Ethics sets out the rules of conduct for members and licensees. Principle 9 of the Code of Ethics requires members and licensees to report to the Association any illegal or unethical professional decisions or practices by members or licensees. Historically, that duty has not been seen by members as including a duty to self-report. At the December 2008 Council meeting, the following resolution was passed:
Commencing January 1, 2009, in accordance with the Code of Ethics, members and licensees shall, within 30 days of its occurrence, advise the Registrar of:Upon request, members and licensees shall provide the Registrar or his or her delegate with whatever additional information they may require.
- any disciplinary action taken against them by another professional regulatory body;
- any conviction for a regulatory or criminal offence; or
- any Settlement or Consent Agreement or similar agreement with a regulatory body.
Self-reporting of convictions and regulatory actions is also consistent with other provisions in the Engineers and Geoscientists Act and the bylaws regarding the granting and cancellation of membership or licensure.
Not all offences need to be reported to the Association. Members and licensees will not be required to report convictions for offences prosecuted pursuant to tickets issued under the Federal Contraventions Act or the BC Motor Vehicle Act.
