Disciplinary Hearing – Ken Dextras, P.Eng., New Westminster, BC

A matter was referred to the Investigation Committee by the Practice Review Committee of the Association concerning Mr. Dextras’ failure to provide the Practice Review Committee with certain documents. The Investigation Committee looked into the matter, but no replies were received to its letters to Mr. Dextras.  The Investigation Committee recommended that an inquiry be held regarding Mr. Dextras’ failure to respond to its request for documents and information, contrary to section 30 (4) of the Act. On April 7, 2008, a disciplinary inquiry relating to the charges was held. Mr. Dextras did not appear at the inquiry.

The discipline panel found the allegations were proven and after hearing submissions on penalty and costs, directed that:

  1. Mr. Dextras be suspended from membership in the Association for 60 days, commencing 30 days from the date of the written Determination and Order;
  2. Mr. Dextras surrender to the Association his seal and Certificate of Registration for the duration of the suspension;
  3. Mr. Dextras pay the Association a fine of $5,000.00; and
  4. Mr. Dextras pay special costs in the amount of $16,500.00.

The Panel further ordered that Mr. Dextras’ membership in the Association remain suspended until he has:

  1. Provided a response to the request from the Investigation Committee contained in the letter from Mr. Thiele of July 19, 2007, that is satisfactory to the Investigation Committee;
  2. Paid the fine to the Association in the amount of $5000.00; and
  3. Paid the special costs.
