Stipulated Order - J. Blair Evans, Vancouver, B.C.

A complaint was made to the Association by Mr. Evans' former employer alleging that Mr. Evans had solicited and secured a contract to provide professional engineering services in the name of his own company. The former employer also provided to the Association a large numberof blank sheets of paper bearing the seal and signature of Mr. Evans, which the former employer allegedly found in Mr. Evans' desk. The matter was investigated by the designated reviewer and was referred to the Investigation Committee, which conducted an investigation and eventually recommended that an inquiry be held.

A Notice of Inquiry was issued by the Association alleging that Mr. Evans demonstrated unprofessional conduct in his signing and sealing the blank sheets of paper and in soliciting and securing a contract to provide engineering services in competition with his employer.

In lieu of proceeding to an inquiry, Mr. Evans accepted a Stipulated Order admitting that he was in breach of the Engineers and Geoscientists Act, and accepted as his penalty:

  1. a three (3) month suspension commencing November 1, 2006;
  2. that he write and pass the Professional Practice Exam during the period of suspension;
  3. that if he fails to write and pass the Professional Practice Exam before March 1, 2007 his suspension will continue until that condition is met; and
  4. payment of the legal and expert costs for the investigation of this matter in the amount of $2,800.00.

As a suspended member, Mr. Evans may not use the titles "P.Eng." or "professional engineer" or any other title implying he is a professional engineer.
