Extraordinary Bylaw Amendment Ballot – Experience Requirement for Registration

As a result of a BC Supreme Court ruling in late September, there is no longer a bylaw that references the experience required to be registered as a professional engineer or professional geoscientist. At that time, APEGBC temporarily ceased to grant licences to new professional engineers (P.Eng.) and professional geoscientists (P.Geo.), until a new experience bylaw could be ratified by the membership. On October 26, 2007, Council approved an amendment to Bylaw 11(e) that more clearly defines in the bylaws the experience required for registration as a professional engineer or geoscientist. Bylaw amendments will be forwarded to the membership by letter ballot for ratification on November 19, 2007. All APEGBC members are strongly encouraged to vote and to support these important amendments.

Council Election & Bylaw Amendment Vote Results

The results of the APEGBC Council election as well as the bylaw amendment vote were announced at the Annual General Meeting held on October 27, 2007 in Whistler, BC.  All proposed bylaw amendments were approved by the membership according to the two-thirds majority prescribed by the Engineers and Geoscientists Act.

APEGBC participated in the tradeshow of the Union of BC Municipalities’ (UBCM) convention, September 24-28, 2007.  The annual convention is attended by elected officials and staff from municipal governments, as well as the provincial government, and APEGBC took the opportunity to promote to the work of the Association and its members to convention delegates.

Discipline & Enforcement

Determination and Order – Fred K. F. Lee, P.Eng., Vancouver, BC

A complaint was received by the Association from the original engineer on a project whose drawings and calculations, without his knowledge or consent, had been signed, sealed and delivered to the City of Port Coquitlam by Mr. Lee. The Investigation Committee, after reviewing the materials, felt there were reasonable and probable grounds to believe that Mr. Lee had breached the Code of Ethics and recommended an inquiry be held.

Revocation – Ross Lance Morton, Innisfail, AB

Commencing April 11, 2007, a disciplinary inquiry relating to Mr. Morton’s failure to respond to a request by the Investigation Committee for documents and information, contrary to section 30(4) of the Engineers & Geoscientists Act, was held. Mr. Morton did not appear at the inquiry. The discipline panel found the allegations were proven and after hearing submissions on penalty and costs, directed that within 60 days of the Order (executed May 7, 2007), Mr. Morton pay a fine in the amount of $5,000 and provide a satisfactory response to the Investigation Committee’s request for documents and information.

APEGBC Concludes Another Successful Annual Conference
