Revocation – Ross Lance Morton, Innisfail, AB
Commencing April 11, 2007, a disciplinary inquiry relating to Mr. Morton’s failure to respond to a request by the Investigation Committee for documents and information, contrary to section 30(4) of the Engineers & Geoscientists Act, was held. Mr. Morton did not appear at the inquiry.
The discipline panel found the allegations were proven and after hearing submissions on penalty and costs, directed that within 60 days of the Order (executed May 7, 2007), Mr. Morton pay a fine in the amount of $5,000 and provide a satisfactory response to the Investigation Committee’s request for documents and information. Mr. Morton was also ordered to pay the Association’s legal costs in the amount of $5,680 within 60 days.
The Association wrote to Mr. Morton on July 10, 2007 and September 20, 2007 requesting payment of the fine and costs and his response to the Investigation Committee. The Association received no response from Mr. Morton and the matter was referred back to the Panel.
In accordance with subsections 34(1) and 35(5) of the Act, the Panel reconsidered this matter on November 2, 2007, and ordered that:
- the membership of Ross Lance Morton is revoked effective the date of the Order; and
- the Panel recommends that Council not consider any application for reinstatement for a minimum of two (2) years and then only if Mr. Morton has met all the conditions described in the original order.
