Jurisdictional Challenge to Discipline Inquiry – Surinder S. Puar, P.Eng., West Vancouver, BC

The Association received information regarding geotechnical engineering services provided by Mr. Puar. The matter was referred to the Association’s Investigation Committee and an investigation was commenced. After reviewing the matter, the Investigation Committee recommended an inquiry be held and referred the matter to the Discipline Committee.

Mr. Puar challenged the jurisdiction of the Discipline Committee to hold an inquiry on various grounds and applied to have the Notice of Inquiry dismissed. A Discipline Committee Panel received lengthy written submissions and heard oral submissions from lawyers for Mr. Puar and the Association.

The Panel issued a decision on September 10, 2008 concluding that it does have jurisdiction to proceed with the inquiry. The question of costs will be dealt with at the conclusion of the inquiry.

The Panel is now arranging dates with legal counsel for the inquiry.
