Stipulated Order – Jerry Lay, P.Eng., Lake Country, BC

Concerns were brought to the Association’s attention regarding the quality of the design and documentation for a number of sewerage systems designed by Mr. Lay. The matter was referred to the Investigation Committee, which decided that it should commence an investigation. A sub-committee was appointed and, after collecting and reviewing information and documents from the member and others, found the work was deficient and recommended an inquiry. That finding and recommendation was supported by the Investigation Committee as a whole and a Notice of Inquiry was issued.

In lieu of proceeding to an inquiry, Mr. Lay admitted the deficiencies in his work set out in the Notice of Inquiry and accepted as his penalty:

  1. A reprimand;
  2. That he complete or transfer to another engineer all sewage system projects by September 30, 2007;
  3. Payment to the Association a fine of $3,000 and legal costs of $8,475 on or before October 1, 2007 or he will be suspended until that money has been paid; and
  4. That he not undertake any new sewage system projects until he has successfully completed training acceptable to the Registrar or has obtained the Registered On-Site Wastewater Practitioner designation from the appropriate authority.
