This seminar will assist professionals with how to make the best choices and minimize legal risks in the tender and RFP process, with particular emphasis on drafting and evaluating tenders and RFPs. Included will be an overview of the law of tender and RFPs, and a discussion of such topics as proposal and contract drafting, non-compliant bids, exercising discretion given by the tender/RFP documents, and recording results and evaluation committee management. There will be opportunities for questions and discussion.

Karen Martin is a partner at Fraser Milner Casgrain who practises in the areas of P3, Construction & Infrastructure and Litigation/Dispute Resolution. Based on the latest developments in the law, she provides advice to minimize risk during the drafting and administration of tender and RFP processes. She also acts as counsel on tender disputes.
More generally, her practice focuses on dispute resolution in the construction industry. She has extensive experience with the litigation, mediation and arbitration of disputes involving construction contracts, builders' liens, engineering issues, professional negligence claims, delays, deficiencies and extra work claims.
Karen's involvement in some of the more significant construction litigation in British Columbia in the last three decades allows her to quickly understand the technical aspects of a construction claim and to provide knowledgeable advice as to the appropriate method to resolve a particular dispute. Her clients include owners, governments, contractors, architects, engineers, and insurers.
