This seminar will assist professionals with how to make the best choices and minimize legal risks in the tender and RFP process, with particular emphasis on drafting and evaluating tenders and RFPs. Included will be an overview of the law of tender, a discussion of recent legal cases, and practical advice on topics such as how to deal with non-compliant bids, exercising discretion given by tender/RFP documents, the duty of fairness, and when negotiation is allowed. There will be opportunities for questions and discussion.

Karen Martin is a partner at Fraser Milner Casgrain, LLP, who practises in the areas of P3, Construction & Infrastructure and Litigation/Dispute Resolution. Based on the latest developments in the law, she provides advice to minimize risk during the drafting and administration of tender and RFP processes. She also acts as counsel on tender disputes.
Karen has assisted clients in the construction industry for almost 25 years to avoid and resolve disputes involving contracts, builders' liens, design issues, delays, deficiencies and change orders, including on P3 projects.
Karen draws on her experience as counsel on large construction litigation and as part of the project team on some of British Columbia's more significant infrastructure projects in recent years to provide knowledgeable advice as to how to best resolve construction disputes.
