New Statement of Compliance for Construction and Operation of Pools

Prompted by the absence of a standardised compliance statement under British Columbia’s Pool Regulation for the construction and operation of pools, and the potential for resulting related professional liability issues, APEGBC and the Ministry of Health have developed a single statement of compliance for this purpose. 

The jointly developed British Columbia Pool Regulation Statement of Compliance eliminates regional differences required by provincial health authorities. Previously, without standardised wording for the statement required under Section 6(2)(a)(i) of the Regulation, some health authorities created their own forms. Some of those forms contain language that goes beyond the requirements of Section 6(2)(a)(i) and includes wording that could potentially:

  • void the insurance policy of the engineer or architect; or
  • make an engineer or architect liable for conditions pertaining to the operation of the pool and over which an engineer or architect has no control once the control of the construction pool has been passed to the pool owner.

The Ministry has obtained the agreement of the six provincial health authorities on the standardised wording and format of the new form. APEGBC’s Council endorsed the compliance statement at its April 2016 meeting. The statement was also reviewed by Architectural Institute of British Columbia (AIBC), and endorsement is being sought from the AIBC Council.
